The Scottish Government's Housing (Cladding Remediation) (Scotland) Bill: What it means for landlords and property owners


The Scottish Government's Housing (Cladding Remediation) (Scotland) Bill is currently making its way through Parliament and is expected to be passed into law in 2024. The Bill will give the Scottish Government new powers to remediate buildings with unsafe cladding that present a risk to life.


It will also introduce a new Building Safety Levy, equivalent to the one already established by the UK Government, to compel developers to make a "fair contribution" financially to cladding remediation.


Implications for landlords and property owners


The Bill has a number of implications for landlords and property owners.


First, it will place a legal obligation on landlords and property owners to remediate unsafe cladding on their buildings. This obligation will apply to all domestic multi-residential high-rise buildings in Scotland, as well as certain categories of other high-rise buildings, such as care homes and hospitals.


Second, the Bill will introduce a new Building Safety Levy, which will be paid for by developers. This levy will help to fund the remediation of unsafe cladding on buildings that have been developed by those developers.


Third, the Bill will give the Scottish Government new powers to intervene and remediate unsafe cladding on buildings where landlords and property owners have failed to do so. This means that landlords and property owners could face financial penalties or even imprisonment if they do not comply with the Bill's requirements.
